Administrative Monetary Penalty System (AMPS)

The Administrative Monetary Penalty System (AMPS) allows by-law related offences to be heard by the Township, instead of through the Provincial Offences Act (POA) and the regional court system.

The AMP system simplifies the process of resolving penalty notices.  It provides the Township with increased discretion to resolve penalty notices and decrease wait times.  The option to issue a Part I or Part III offence (notice to appear in court) for more serious matters or for repeat offenders remains an option for by-law enforcement.

Why use AMPS?

    • It is a fair and efficient process for collecting, appealing and paying penalties for non-compliance of by-law related offences.
    • It decreases wait times and improves the customer’s experience.
    • It improves safety and by-law compliance in the Township
    • It streamlines the enforcement process
    • It removes these offences from the court system.
    • Reviews of penalties are conducted by independent Officers appointed by the Township of Huron-Kinloss 

You have 15 days from the issue date of your penalty notice to pay the infraction or appeal the notice.

  • Pay online 
  • By mail – send the payment (cheque or money order) payable to the Township of Huron-Kinloss. Please include the Penalty Notice Number with your payment.
  • In person at the Municipal Office during operational hours

If the notice is not appealed and remains unpaid after 15 days, the penalty is increased by 25% and late payment fees will apply.

Penalties and associated administrative fees that remain unpaid may be added to the tax roll to be collected in the same manner as municipal taxes. 

Screening Officer Review

You can dispute a penalty notice (ticket) or request an extension to the time for payment by booking a screening with a screening officer. To book a screening, please complete the Request a Hearing Form.  

  • You have 15 days from the date of the penalty notice to request a screening.
  • The screening officer can confirm the penalty, adjust fees or payment timing or cancel the penalty.  
  • Notice will be given to you of the time, location, and method of the screening hearing.
  • If you don’t attend your review appointment, the appeal is dismissed.  A non-appearance fee will be added to the penalty and any associated administrative fees. 

You can request that a Hearing Officer review the decision of the Screening Officer.  To request a Hearing Officer Review, submit the Request for Hearing Form.  The request needs to be made within 15 days of receiving the Screening Officer Decision. In exceptional cases this may be extended to 30 days. 

Hearing Officer Review

A Hearing Officer will review the decision of the Screening Officer. The Hearing Officer will conduct the hearing according to the Statutory Powers Procedure Act, R.S.O. 1990, c. S.22.  The Officer will consider the submitted evidence before making a decision.

  • The Hearing Officer can confirm the penalty, adjust fees or payment timing or cancel the penalty.
  • Notice will be given of the time, location, and method of the hearing.
  • If you don’t attend your review appointment, the appeal is dismissed.  A non-appearance fee will be added to the penalty. 
  • The decision of the Hearing Officer is considered final and binding.
  • The penalty becomes immediately payable following the hearing unless otherwise noted in the decision of the Officer.

Evidence

All evidence to support your appeal must be included when submitting a Request a Hearing Form. Bring copies of documents that were submitted as evidence to the Hearing. Document examples may include: a death certificate, police report, medical note, photographs, condominium letter/lease or accessible parking permit. If you require additional time to pay, bring documents to support your financial hardship claim.

If you are sending someone to act on your behalf, complete an Authorization to Act as an Agent Form.
